1. For Department of Personnel and Administration:
The functions under this department are described below:
Designing and implementing human resources management policies and procedures governing recruitment, placement, rewarding, training and development and welfare service.
 
Reviewing human resources management policies and recommending proposals related to improvement of working conditions and motivation of the workforce.
 
Making follow up on the implementation of human resources management policies and training plans/programmes;
 
Designing and implementing on employee’s performance system with respect to departmental and corporate plans;
 
Handling industrial disputes and representing the management in industrial cases;
 
Designing and implementing a system for the provision of general services, transport, stores, cleaning and maintenance of assets; Procurement and storage of office supplies.
 
2. For Department of Finance and Accounting:
The functions under this department are described below:
Carrying out financial planning and control;
 
Designing a computerized accounting and reporting system for CMSA;
 
Preparing and maintaining accounting books and records;
 
Preparing of periodic financial reports for both internal and external; reporting;
 
Coordinating the preparation of the annual budget of CMSA;
 
Advising on short term investment plans for CMSA;
 
Advising the Chief Executive Officer on all matters relating to finance and accounting;
 
Teaming up with other departments in the evaluation of Prospectuses;
 
Providing support to the Market Supervision Department in the analysts of the financial performance of listed companies, Collective Investment Schemes and market professionals including dealers/brokers and investment advisors;
 
Providing advise on the disclosure and accounting standards requirements for the market, listed companies, collective investment schemes and market professionals;
 
Undertaking any other duties assigned by CEO.
 
3. For Directorate of Legal Affairs and Enforcement:
The functions under this directorate are described below:
a) General:
Interpreting of the CMS Act, Regulations and other legislation;
 
Drafting of regulations and amendments to legislation;
 
Providing legal opinions on capital markets issues and /or issues affecting the Authority;
 
Providing legal advice on the Authority’s compliance with pertinent laws of Tanzania in its day to day affairs;
 
Providing legal representation for the Authority;
 
Providing legal advisory services to the Authority;
 
Advising the CEO on regulatory aspects relating to policy measures/proposals; and
 
In cooperation with the Directorate of Research, Policy, and Planning undertaking research relating to the regulatory/ legal matters relevant to the capital markets.
 
b) Board Matters:
Providing services to the meetings of the Authority;
 
Providing the communication link between the Members of the Authority and the CMSA;
 
Making follow-up implementation of decisions of the Authority.
 
c) Enforcement:
Evaluating and processing applications for licensing or renewal of licenses of brokers, dealers, investment advisors;
 
Issuing licenses to brokers, dealers, dealers representatives and investment advisors;
 
Inspecting licensees;
 
Taking part in evaluation of applications for approval of prospectuses/new issues or mergers and acquisitions;
 
Taking part in evaluation of applications for authorization of Collective Investment Schemes;
 
Vetting of advertisement and or press announcements made by the CMSA;
 
Carrying out investigations regarding breach of CMS Act, Regulations, Guidelines;
 
Facilitating the settlement of industry disputes and/ or arbitration;
 
Enforcing the CMS Act and Regulations by imposing the requisites penalties;
 
Assisting the CEO in issuance and implementation of the Authority’s guidelines.
 
4. For Directorate of Market Supervision and Market Development:
a) Market Supervision:
Creating and managing data bank for the market;
 
Reviewing and Evaluating market participants (DSE, CIS, CDS, Issuers, Brokers, etc)
 
Conducting onsite and off-site inspection and examinations;
 
Carrying out routine inspections of licensees to ensure compliance with the law;
 
Reviewing extent of compliance with disclosure requirements;
 
Assessing and evaluating systems adopted by market participants;
 
Supporting licensing of market participants;
 
Reviewing impact of various regulations on the market;
 
Participating in the IPO approval process.
 
b) Market Development:
Carrying out public education programme including published materials such as brochures designed to enhance public knowledge on capital markets issues;
 
Participating in capacity building for the market professionals;
 
Coordinating activities relating to the introduction of new products in the market;
 
Coordinating activities relating to development of the market infrastructure;
 
Coordinating activities relating to prospectus evaluation for new issues, mergers, acquisitions and take-overs
 
5. For Directorate of Research, Policy and Planning
c) Department of Research and Policy
Preparing Work plan (Strategic Plan);
 
Completing/preparing annual activity plan;
 
Preparing quarterly reports;
 
Preparing annual reports;
 
Preparing research agenda for CMSA;
 
Coordinating research activities;
 
Publishing and disseminating research results;
 
Preparing and coordinating donor funded projects and projects reports; and
 
Coordinating international cooperation activities.
 
d) Department of Information Technology
Undertaking system analysis at the CMSA and the market as a whole;
 
Dealing with software acquisition and development;
 
Dealing with hardware acquisition and maintenance.
